The preliminary ruling by a federal judge in Texas is an assault on science and the FDA’s long-standing role as the authority to make decisions on the safety and efficacy of medicines. For a court to invalidate the approval of a drug that was reviewed and approved more than two decades ago is without precedent. As legal scholars have noted, the courts do not have the medical expertise to make these types of scientific determinations.

We’re disappointed in the court’s ruling. But we note that the ruling does not resolve the issue of the time limit. It simply notes that the dispute about the time limit stands in the way of finding a ‘clear and indisputable right,’ as would be necessary for the specific relief sought in the lawsuit.

Although this is a very technical ruling, its basic gist is that state supreme courts can’t rely upon novel state procedural rules to prevent state prisoners from bringing federal constitutional claims, (John) Cruz may or may not prevail on his federal claim – that he had a right to have the jury know that a life sentence would be without parole. But he now gets to make that argument in the first place.

This order is procedurally bizarre, in that it agrees to a request to freeze a district court ruling by states that weren’t even parties to that decision solely to decide whether they should have been allowed to intervene and defend that ruling on appeal, title 42 aside, that has enormous potential consequences for the ability of states going forward to fight to keep the current president from rescinding policies of her predecessors.

This a great victory for workers who have the courage to join together and organize in a system that is currently stacked heavily in favor of employers like Tesla who have no qualms about violating the law, while we celebrate the justice in today's ruling by an increasingly pro-worker The NLRB, it also nevertheless highlights the substantial flaws in U.S. labor law. Here is a company that clearly took numerous aggressive and unlawful steps to block workers' rights, and yet it is more than four years down the road before workers see a modicum of justice.
