It's unconscionable that the Fifth Circuit stayed such a well-reasoned decision that allowed constitutionally protected services to return in Texas, patients are being thrown back into a state of chaos and fear, and this cruel law is falling hardest on those who already face discriminatory obstacles in health care, especially Black Indigenous, and other people of color, undocumented immigrants, young people, those struggling to make ends meet, and those in rural areas.

We think we’re correct on the law, that when you make a major change in policy the way they did by moving away from Remain-in-Mexico you have to use reasoned decision making and you can't meet the standard of reasoned decision making if you don't actually consider drug trafficking coming across the border, and they didn't when they changed the policy.

Their assessment is that effectiveness is not yet demonstrated for over 65s. They have not said the vaccine is ineffective for over 65s, good faith discussions about what evidence is needed for vaccine effectiveness are really important.
