To charge that offense, our office would have to be able to prove, beyond a reasonable doubt, the minor specifically intended to kill the victims. There was no evidence of that. the probation officer had access to the reports and alleged facts in the case, the juvenile’s prior, and any mitigating or aggravating factors; but still recommended camp.

The probation officer had access to the reports and alleged facts in the case, the juvenile’s prior, and any mitigating or aggravating factors; but still recommended camp, the probation officer had room to recommend a harsher sentence for these felony charges but chose not to...That together with the fact the judge went along with the recommendation carries a lot of weight -- and lend support to the idea that this was a fair and reasonable resolution of the case.

Probation and parole are a large part of the criminal justice program and should be a significant partner in any gun violence reduction strategy.

I was very disappointed there wasn’t one mention of starting to refocus and strategically target persons that are carrying guns illegally, especially previously convicted felons and persons on probation or parole, as that should be the backbone of any anti-violence program in Philadelphia, but since he’s taken office, we’ve seen a significant reduction in prosecutions in general and for persons carrying guns illegally. I think that’s counterproductive for a time when the city of Philadelphia is setting records for gun-related homicides and shootings.

Shifting costs to' users' of the criminal legal system creates extraordinary hardships for defendants and their families, in addition to erecting sometimes insurmountable barriers to re-entry, legal financial obligations require probation and parole officers to allocate substantial time to acting as collection agents that could otherwise be devoted to rehabilitation and public safety.

This is a real crack in our system, that this person after he commits another crime… his probation should have been violated at that time. If that happened, this officer wouldn't have been shot and this guy wouldn't have been dead.

I want to address that issue that was raised yesterday about records, sen. [Ted] Cruz, R-Texas, raised a very legitimate question about data related to U.S. probation officer recommendations. The White House and members of this committee use that information to attempt to discredit information raised by Senator Hawley and others about the nominee's sentencing record as a district judge. No one on our side of the aisle had access to this information.

Because of George Gascon's blanket policy against transferring any juvenile to adult court, even if the 17-year-old rapes or murders an innocent child, James Tubbs will not have to register as a sex offender, will not spend any time in county jail or state prison, will be 26 and housed with juveniles for a very short period of time, and will be released with no probation or parole monitoring. The victims will get no justice. The public will get no safety.

At this point, we don't have information that indicates that the California Law Enforcement Telecommunications System (CLETS) isn't working as intended on our end when it comes to the ability to access information regarding individuals entered into the system. Generally speaking, law enforcement are able to access information about an individual's probation or parole status by directly querying the supervised release file via CLETS upon the arrest or detention of an individual who is suspected of having committed a crime. That information should be available immediately upon being queried.

I agonized. I'm not ashamed that to say that I actually prayed over what is the appropriate sentence in this case because there was great pain. There was great harm. There were multiple crimes committed in the case, it seems to me that a sentence that involves incarceration or partial incarceration isn't appropriate, so I am going to sentence you to probation.

It has become evident to me in the riot cases that many of the defendants who are pleading guilty are not truly accepting responsibility, they seem to me to be trying to get this out of the way as quickly and as inexpensively as possible -- stating whatever they have to say in the guilty plea, getting probation, and hoping that would be the end of it.

They reconstructed the bill to $ 500,000 and I have to follow all these rules. I had to make promises get a job, do community service, I can't get rearrested, and if I violate any of these conditions, they were going to revoke the money. ... It's like I'm on parole or probation even though I'm free.

Some of my defendants in some of these other cases think there's no consequence to this, and there is a consequence, i don't want to create the impression that probation is the automatic outcome here, because it's not going to be.

At a minimum, this is overstep by the probation department. Probation's job is to protect the community, protect the probationer, and ensure the probationer doesn't flee. But it's far beyond the role of probation to limit speech in the name of policing whether its subjects are' glamorized' in the public eye.

Huffman's lawyers argued that the sentencing guidelines in those cases were much higher and reserved for the mastermind of schemes, not mere participants. Prosecutors, meanwhile, had argued that universities and testing companies were the victims of the schemes, and the amount that parents paid should correspond to the penalties' severity. But US Probation and Pretrial Services, which prepares pre-sentence investigation reports for each defendant, has argued overall, that the universities and testing companies suffered no monetary harm, and the price of the parents' bribes is therefore not relevant to any sentences. The amendment says, if you read it, that you have to complete your sentence. And I think most people understand you can be sentenced to jail, probation, restitution if you harm someone. You can be sentenced with a fine. People that bilk people out of money, sometimes that's an appropriate sentence. That's what the constitutional provision said.
