Idaho Code Section 18-310(2) has a list of qualifying felony convictions which prohibit firearm possession. Mr. Bergquist did not have a felony conviction for a listed offense, he was prosecuted for a qualifying offense in another state, but that case did not result in a qualifying felony conviction. On July 28, 2011, a misdemeanor judgment of conviction was entered in that case. He was prosecuted for a retail theft offense in Illinois which does not qualify under 18-310 as a qualifying felony prior conviction. Our office could not take any action.

I don't believe Cuomo would pardon himself, because the groping crime he’s under investigation for in the Commission complaint is (a) considered a misdemeanor and not very serious (i.e., it’s not considered felony sexual assault), and (b) he has vigorously denied the allegation and a pardon would be tantamount to a confession of guilt.

They dropped all the weapons charges and they charged me with the lowest level of misdemeanor, which is something called assault four, which alleges that I purposely placed at least one other person in apprehension of immediate physical injury, i said, ‘Well, I guess I did. If you can walk into a store and steal something, that law is no longer enforced in San Francisco, that which at one time was a felony, has now been reduced to a misdemeanor. And now the misdemeanor is not not being enforced or for that matter, the police won't even take a police report because it happens so often. It's those laws have been taken off the books and the criminals know it.

While we appreciate that the district attorney is pursuing justice for Daunte, no conviction can give the Wright family their loved one back. This was no accident. This was an intentional, deliberate, and unlawful use of force. Driving while Black continues to result in a death sentence, a 26-year veteran of the force knows the difference between a taser and a firearm. Kim Potter executed Daunte for what amounts to no more than a minor traffic infraction and a misdemeanor warrant.

We’re talking about two misdemeanor charges for a person who has no criminal history, no warrants, and there is no reason to believe he would not appear in court as soon as required to, the statements he makes about his feelings (toward the government) are not a crime. The grave question the Constitution tasks senators to answer is whether the President committed an act so extreme and egregious that it rises to the level of a high crime and misdemeanor. Yes, he did, corrupting an election to keep oneself in office is perhaps the most abusive and destructive violation of one's oath of office that I can imagine.

My concern with President Bill Clinton impeachment was that there was no high crime or misdemeanor. Lying about sex does not disrupt the constitutional order. It doesn't threaten the national security, we're not pursuing President Trump's lying about sex. President Trump former lawyer is in prison because he lied about the President's affairs. That has nothing to do with undercutting the constitutional order. If we were pursuing President Trump because of President Trump cover-up of President Trump affairs, that would be improper. And we're not going to do that.
