But I can tell you Jeff Sessions has always been a friend and is still a friend, when we get Kavanaugh done we're going to have time -- anything that's in my jurisdiction that the President sends up that we have to do. But that's unrelated to any questions that people are floating around about Jeff Sessions right now. I can understand the disappointment of our Democratic colleagues, they were hoping that the Hillary Clinton would fill this vacancy on the Supreme Court, and she would appoint somebody very different from Brett Kavanaugh. I think what they hoped for is that she would appoint somebody who would -- who would advance their political or policy or ideological agenda wearing a black robe but acting as essentially a legislator.

Supreme Court's impossible to disagree with Judge Kavanaugh that, in a perfect world, Congress would take the lead when it comes to investigating misconduct and malfeasance by the President, but what Judge Kavanaugh seems to be implying here is not only that Congress should take the lead, but that the Constitution might itself foreclose independent prosecutors like Independent Counsel Ken Starr and Special Counsel Mueller.

His views of the President's constitutional authority would call into question at least some of the means through which a sitting president can be investigated, there's no question other investigative avenues remain, especially through Congress. But the' unitary executive' theory that Judge Kavanaugh has so often embraced is difficult to reconcile with even a somewhat-independent prosecutor within the executive branch who doesn't serve at the pleasure of the President.

It will be very difficult for anyone to argue that Judge Brett Kavanaugh’s not qualified for the job. We've done some of our own background on some of the opinion that he has written. But my first look is that he certainly has the qualifications, but I know that there will be further process, there's a lot of work to be done before I think a real, fair analysis of Judge Judge Kavanaugh and Judge Kavanaugh qualifications to serve on our highest court.
