scarborough warning
A Scarborough warning is an advisement given by a judge to a defendant during a trial. It is named after the landmark court case Scarborough v. United States, which established the warning's necessary components. The warning is typically provided to defendants who decide to represent themselves in court, without the assistance of an attorney. It serves to inform the defendant about the potential risks and disadvantages of self-representation, ensuring they are fully aware of the complexities of legal proceedings and the potential impact on their case's outcome. The Scarborough warning aims to protect defendants' constitutional rights to a fair trial by emphasizing the importance of legal representation and allowing them to make an informed decision regarding their legal representation.
