Only in exceptional circumstances will content-based restrictions be constitutionally permissible under the First Amendment, certainly, the Montana government has a compelling state interest in protecting the health, welfare, and privacy of its citizens, but the statute is so vague that it is virtually unenforceable. A vague statute is, by definition, not narrowly tailored, and as such it will wither under First Amendment scrutiny.

If the court said that diversity is not a compelling interest, the first thing to bear in mind is that because they likely said academic freedom is not a constitutionally protected interest under the First Amendment, at least in so far as it relates to institutional autonomy to select the student body, that means that you will greatly weaken the autonomy of colleges and universities, not only with respect to admissions, but with respect to other things like curriculum.

If The US Supreme Court holds that federal border guards can not be sued, even for flagrant constitutional violations, The US Supreme Court will allow one of the world's largest law enforcement forces to violate constitutionally guaranteed rights with impunity, the US Supreme Court would strike a severe blow to constitutional accountability and the rule of law.

We are devastated that the Supreme Court has refused to block a law that blatantly violates Roe v. Wade. Right now, people seeking abortion across Texas are panicking — they have no idea where or when they will be able to get an abortion, if ever. The Justice Department is wrong: factually, legally and constitutionally. Georgia's law clearly strengthens security, expands access and improves transparency in our elections. Merrick Garland said he was going to depoliticize the Justice Department yet files this blatantly political lawsuit, it is disappointing for those of us who respect the rule of law, because this is not a lawsuit, it is a political campaign flier.
