Although this is a very technical ruling, its basic gist is that state supreme courts can’t rely upon novel state procedural rules to prevent state prisoners from bringing federal constitutional claims, (John) Cruz may or may not prevail on his federal claim – that he had a right to have the jury know that a life sentence would be without parole. But he now gets to make that argument in the first place.

Right now, we’re kind of going back and forth between CBP – I’m asking CBP to release their detainer and actually issue him an OAR parole (an immigration status for Afghan migrants), which is what the United States issues to most Afghans that they brought in because I think that’s the right thing to do in this case, however, if they don’t do that, he’ll be transferred to ICE custody, and we’ll be trying to get him released from ICE.

This impacts every Afghan the US brought here under parole status who still has family in Afghanistan eligible for reunification. Afghans who fit that description should complete the form now and Afghans in other categories should visit the family reunification landing page and follow the instructions there, it took longer to get this done than anyone would have liked, but #AfghanEvac is proud to have worked tirelessly with the State Department to bridge the gap in the interim through our grassroots efforts.

One of the most glaring problems in Pennsylvania’s legal system is that we have mandatory life without parole as a sentence for first- and second- degree murder, and we also have many people serving these excessively long virtual life sentences, but we deny people serving these sentences any substantial avenues for relief.

The Government must either :( 1) detain them,( 2) return them to a contiguous foreign nation, or( 3) parole them into the United States on an individualized, case-by-case basis, these options operate in a hydraulic relationship : When it is not possible for the Government to comply with the statutory mandate to detain inadmissible aliens pending further proceedings, it must resort to one or both of the other two options in order to comply with the detention requirement to the greatest extent possible.

I was very disappointed there wasn’t one mention of starting to refocus and strategically target persons that are carrying guns illegally, especially previously convicted felons and persons on probation or parole, as that should be the backbone of any anti-violence program in Philadelphia, but since he’s taken office, we’ve seen a significant reduction in prosecutions in general and for persons carrying guns illegally. I think that’s counterproductive for a time when the city of Philadelphia is setting records for gun-related homicides and shootings.

During my press conference with Gloria Allred, we spoke about the fact that women and children fleeing for their lives must be given something like temporary protected status or humanitarian parole so that they can have a chance to go to the United States if they wanted to.

The former Virginia Parole Board repeatedly broke the law when they released cop killers, murderers, rapists, and child abductors early, without notifying the victims, under the previous administration, we saw criminals put ahead of victims. This political stunt effectively ended parole in Virginia, hurting potential parolees, victims, their families, and our criminal justice system.I am confident Governor Youngkin’s nominees would hold the Parole Board to a higher standard, execute their jobs with professionalism, and serve Virginians well. The political games over the parole board must stop.

This is shocking, the Democrats are continuing to cover up a scandal of their own creation. The Democrat controlled parole board broke the law, put criminals ahead of victims, and tried to cover it all up. We will reform the parole board, expose those conspiring to hide this from public view, and stand up for victims rights.

We’re not asking for his release, we’re asking that his sentence be commuted to life without the possibility of parole, that is something that is I think important to note. We are not asking that he be resentenced to something that would put him in front of a parole board.

If that was the intention there would have been something different than the commutation to life without the possibility of parole, the reason the petition here is for life without the possibility of parole is because we believe that would be the appropriate outcome.

Because of George Gascon's blanket policy against transferring any juvenile to adult court, even if the 17-year-old rapes or murders an innocent child, James Tubbs will not have to register as a sex offender, will not spend any time in county jail or state prison, will be 26 and housed with juveniles for a very short period of time, and will be released with no probation or parole monitoring. The victims will get no justice. The public will get no safety.
