What a lot of school leaders have learned is don’t react quickly. You’ve got a lot of pressure to do something right away but it’s really better to be thoughtful, you should assume that you don’t have a good picture of what really happened and what didn’t. Be very skeptical about claims that this saves lives or people died because of that. In Tennessee no one will have a really accurate picture of what happened there for months.

Although this is a very technical ruling, its basic gist is that state supreme courts can’t rely upon novel state procedural rules to prevent state prisoners from bringing federal constitutional claims, (John) Cruz may or may not prevail on his federal claim – that he had a right to have the jury know that a life sentence would be without parole. But he now gets to make that argument in the first place.

We’re not totally surprised that when the New York state legislature decided to abolish the statute of limitations, it was going to lead to a number of stale allegations that are being revived, our position is that the statute is unconstitutional, because it revives claims that have been barred by the statute of limitation for a long time, and that it sets a very dangerous precedent, legally speaking, and not just in the context of old assaults.
